Compensation Awarded for Orthodontic Medical Negligence in Bahrain

A court in Bahrain awarded a woman compensation after medical negligence during her orthodontic treatment. This case highlights the importance of medical negligence compensation in protecting patients’ rights.

Nine years ago, the woman began orthodontic treatment to fix gaps and jaw issues. The treatment was expected to improve her smile. However, instead of healing, her dental condition worsened. She developed severe cavities and chronic gum disease.

The woman filed a lawsuit against the medical center and the dental technician responsible for her care. She requested 10,000 dinars in compensation for damages caused by the treatment. The claim included legal interest from the date of filing until full payment.

A criminal judgment convicted the dental technician of endangering the patient’s bodily integrity due to medical malpractice. The technician was fined 200 dinars. Meanwhile, the National Health Regulatory Authority investigated the case thoroughly.

Their report revealed that the dental technician failed to address the patient’s worsening condition. The technician did not warn the woman about the risks of continuing with braces. This lack of care worsened her dental health.

The court held the medical center responsible for the technician’s errors. It ruled that the center neglected to provide proper care and warning. Despite no permanent disability found, the court acknowledged that her condition worsened because of this negligence.

As a result, the court ordered the medical center to pay 1,450 dinars in medical negligence compensation. This covered both material and moral damages. The center must also pay interest at 3% per year from the lawsuit date until full payment.

Additionally, the medical center must cover attorney fees and the costs of the medical committee’s investigation. This ruling sends a clear message about the importance of medical negligence compensation in Bahrain.

Medical negligence compensation serves as a vital protection for patients harmed by careless medical treatment. This case emphasizes the legal and ethical responsibilities medical centers must uphold to safeguard patient health.
