DIFC Courts See Surge in Caseloads

The DIFC Courts have witnessed a significant rise in activity during the first half of 2025. The English-language court system processed 650 claims valued at Dh6.8 billion, confirming its growing appeal in cross-border commercial dispute resolution.

Notably, the Court of First Instance (CFI) recorded 61 claims worth Dh6.7 billion. This figure included an average claim size of Dh117.7 million, underscoring the court’s reputation for handling high-value, complex cases. Chief Justice Wayne Martin remarked that the increase in opt-in matters and larger claims reflects continued trust in DIFC Courts.

Moreover, activity rose sharply across all court divisions. The Civil & Commercial Division saw an 85% increase in filings, totaling Dh2.3 billion. Meanwhile, the Arbitration Division logged a 92% jump with 23 cases worth Dh4.5 billion, averaging Dh342.6 million per claim.

The Small Claims Tribunal (SCT) also grew rapidly. It handled 458 cases totaling Dh43.2 million, marking a 73% rise from the previous year. Although enforcement claims dropped slightly, the broader surge in filings highlighted widespread confidence in DIFC Courts’ processes.

Sectors involved ranged from banking and retail to crypto and real estate. Many claimants opted into the DIFC jurisdiction contractually, showcasing the courts’ international enforceability and bilingual capabilities. Opt-in rates stood at 38% for CFI, 39% for SCT, and 18% for arbitration.

The DIFC Wills Service Centre registered 922 wills, a 14% increase from last year. Additionally, the Pro Bono Programme served 524 individuals, with support from 39 law firms and 51 legal professionals.

Director Justice Omar Al Mheiri stated that this steady growth proves the value businesses place on a stable legal framework. He emphasized that DIFC Courts are evolving to support a dynamic, modern economy.

Legal developments have also strengthened the court’s authority. In March 2025, Dubai issued Law No. (2) of 2025, expanding the DIFC Courts’ jurisdiction to include all civil, commercial, and labour matters. The reform merges older laws and ensures procedural clarity.

In conclusion, DIFC Courts continue to cement their role as a pro-business judicial hub. Their transparent, efficient, and arbitration-friendly approach remains vital to the UAE’s legal and economic landscape.
