Shura Council Discusses Amendments to Real Estate Rental Law in Bahrain

The Shura Council’s Public Utilities and Environment Committee recently held a meeting, chaired by Dr. Mohammed Ali Hassan Ali. They discussed a draft law amending provisions of the Real Estate Rental Law, Law No. 27 of 2014. The main goal of the amendment is to create clear rules for situations where tenants must return leased properties, especially when landlords refuse to take possession.

A key part of the draft law is limiting the legal extension of expired lease contracts to just one year. This applies regardless of the original contract length. The law aims to provide clarity and predictability in lease renewals. This will help tenants and landlords manage their obligations effectively. The draft law also seeks to ensure a fair balance of rights and responsibilities for both parties.

The committee reviewed the core principles of the draft law. These principles align with Bahrain’s Constitution, especially Article 9, which supports economic fairness and social justice. The law respects the constitutional rights of property owners and tenants. The proposed amendments protect both parties’ rights and create a legal framework that reduces disputes. It ensures mutual responsibility in lease agreements.

The committee also reviewed input from the legal advisor and legislative comparison table. They considered feedback from the Legislative and Legal Affairs Committee of the Shura Council and the House of Representatives’ report. The committee decided to invite relevant authorities for further feedback before making final recommendations.

Through these discussions, the committee is working to ensure that the draft law balances the interests of tenants and landlords. This will contribute to a fairer and more just real estate environment in Bahrain.
