Dubai Court Orders Refund After Surgery Dispute

A Dubai Civil Court has ordered a medical centre to return Dh159,000 to a patient after failing to perform an agreed surgical procedure. The ruling also awards the patient Dh5,000 in compensation for material and moral damages. Additionally, the court required the centre to pay legal fees, including lawyer’s charges.

The dispute arose when the patient transferred the full amount for surgery under a formal contract. The medical centre repeatedly postponed the operation without confirming a new date. Consequently, the patient missed the appropriate timing for the procedure, causing distress and financial inconvenience.

To support her claim, she submitted bank transfer records and electronic messages. These messages confirmed the agreement, acknowledged the payment, and documented the postponements. The patient also provided the centre’s commercial licence, showing it operates as a single-owner limited liability company specializing in day surgeries.

The court emphasized that repayment requests inherently included contract termination claims. It stated that the patient met her obligations by paying the agreed fee, while the medical centre failed its essential duty to perform the surgery. This breach justified canceling the contract and restoring both parties to their original positions.

The ruling further confirmed that electronic communications are valid evidence if not contested. Interest on the refund was calculated from the date of the lawsuit to compensate for the delay in fulfilling financial obligations. This approach ensures patients receive timely redress and reinforces healthcare accountability.

Legal experts note that the case highlights Dubai’s commitment to enforcing contracts and protecting consumer rights. Patients now have a clearer precedent to claim compensation for medical services that fail to meet contractual commitments.

Overall, the Dubai medical refund case sets an important standard for healthcare providers, reminding them to honor agreements promptly. It also empowers patients to seek legal remedies when medical services fall short.
